1 Scope of application
  1. The following General Terms and Conditions apply to all business relationships between VBS Vet Verlag Beratung und Seminar GmbH and the customer. The version valid at the time of conclusion of the contract shall apply.
  2. Deviating, conflicting or supplementary General Terms and Conditions shall not become part of the contract, even if we are aware of them, unless their validity is expressly agreed to in writing.
  3. The term “course” is used here: Classroom courses, seminars, workshops and other (face-to-face) events.
2 Conclusion of contract
  1. The offers on the Internet represent a non-binding invitation to the customer to purchase services. Only by clicking on the order button does the customer submit a binding offer to conclude a service contract.
  2. The offer is accepted by VBS Vet Verlag Beratung und Seminar GmbH by e-mail in the form of a confirmation letter. The service contract is concluded upon receipt of this e-mail.
  3. The use of services (online seminars) requires certain system requirements in terms of hardware, software and internet connection. As a rule, we use the service provider Zoom to conduct our online seminars. The necessary technical requirements can be found at the provider’s web address. Find out about the specific system requirements in advance.
  4. Without these system requirements, the transmission of web content etc. is only possible to a limited extent.
  5. VBS Vet Verlag Beratung and Seminar GmbH shall not be liable if the ordered service cannot be used or cannot be used in accordance with the contract due to customer system features that do not meet the requirements for which the customer is responsible. Withdrawal, compensation for damages and the right to rectification of defects are excluded in this respect.
  6. VBS Vet Verlag Beratung und Seminar GmbH reserves the right to change dates, starting times, speakers and seminar content, in particular due to legal regulations and for important reasons. Participants will be informed immediately and in an appropriate manner.
  7. If an on-site seminar or webinar cannot take place – for whatever reason – after two alternative dates, the participation fee will be credited without deductions. Further claims against VBS Vet Verlag Beratung und Seminar GmbH (e.g. travel costs, loss of earnings, etc.) are excluded.
  8. Unless expressly stated otherwise, for legal reasons the services offered may only be provided to veterinarians, students of veterinary medicine and other persons (target group “professionals”). The prerequisite for participation in the course is the presentation of suitable proof in the form of a copy of the license to practice medicine or a copy of the certificate of matriculation. In the event of non-presentation, VBS Vet Verlag Beratung und Seminar GmbH may withdraw from the contract with immediate effect. The same applies if the customer has provided false information regarding the existence of the requirements. The right to claim damages remains reserved. Claims for damages by the customer are excluded to the extent permitted by law.
3 Compensation
  1. All prices quoted in our online store are net prices plus the applicable statutory value added tax and do not include shipping costs.
  2. As soon as the visitor has registered with their address and home country, the prices appear as gross prices with the VAT of the visitor’s country of origin, depending on the product group. If the registered customer or prospective customer logs in again, the prices for their country of origin will appear again. The customer is responsible for the accuracy of their own data and undertakes to update and correct it if necessary.
4 Purchase of goods

Conclusion of contract

  1. The conditions for goods from VBS Vet Verlag Beratung und Seminar GmbH are subject to change and non-binding. The presentation of goods on the Internet does not constitute an offer, but a non-binding invitation to the customer to place an order. We reserve the right to make technical and other changes in form, colour or weight within reasonable limits.
  2. The online order merely represents an invitation by the customer to VBS Vet Verlag Beratung und Seminar GmbH to conclude a purchase contract. The confirmation of receipt of the order by e-mail does not constitute acceptance, but merely informs the customer that his order has been received by VBS Vet Verlag Beratung und Seminar GmbH. Receipt of an order by telephone does not constitute binding acceptance by VBS Vet Verlag Beratung und Seminar GmbH. Acceptance of the order takes place by dispatch of the goods or a confirmation e-mail.
  3. The VBS Vet Verlag Beratung und Seminar GmbH reserves the right not to accept online orders or to limit the quantity.
  4. The conclusion of the contract is subject to the reservation that in the event of incorrect or improper self-delivery, VBS Vet Verlag Beratung und Seminar GmbH shall not perform or only partially perform. This only applies in the event that VBS Vet Verlag Beratung und Seminar GmbH is not responsible for the non-delivery.
  5. In the event of non-availability or only partial availability of the goods, the customer will be informed immediately. The consideration will be refunded immediately.
  6. The goods will be delivered to the delivery address specified by the customer.

Warranty (for the sale of goods)

  1. Consumers within the meaning of § 13 BGB (German Civil Code) have the choice of whether the supplementary performance is to take the form of rectification or replacement delivery. VBS Vet Verlag Beratung und Seminar GmbH is entitled to refuse the type of supplementary performance chosen if it is only possible at disproportionate cost and the other type of supplementary performance does not cause significant disadvantages for the consumer. In the case of companies, VBS Vet Verlag Beratung und Seminar GmbH shall initially provide warranty for defects in the goods at its discretion by repair or replacement.
  2. If the supplementary performance fails, the customer may, at his discretion, demand a reduction of the remuneration (reduction) or rescission of the contract (withdrawal) as well as compensation. In the case of only minor defects, the customer shall not be entitled to withdraw from the contract. If the customer chooses compensation, the limitations of liability pursuant to § 7 of the GTC shall apply.
  3. Consumers must notify VBS Vet Verlag Beratung und Seminar GmbH in writing of obvious defects in the goods within two months of receipt; otherwise the assertion of warranty claims is excluded.
  4. Entrepreneurs must inspect the delivered goods immediately for deviations in quality and quantity and notify VBS Vet Verlag Beratung und Seminar GmbH in writing of any recognizable defects within a period of one week from receipt of the goods; otherwise the assertion of warranty claims is excluded. Hidden defects must be reported to VBS Vet Verlag Beratung und Seminar GmbH in writing within one week of discovery. Timely dispatch is sufficient to meet the deadline. The entrepreneur shall bear the full burden of proof for all claim requirements, in particular for the defect itself, for the time of discovery of the defect and for the timeliness of the notice of defect.
  5. For consumers, the warranty period is two years from delivery of the goods. For entrepreneurs, the warranty period is one year from delivery of the goods.
  6. VBS Vet Verlag Beratung und Seminar GmbH does not give any guarantees to its customers in the legal sense. Manufacturer warranties remain unaffected by this.
5 Shipping costs
  1. If goods have to be shipped, shipping costs are to be added to the final price of a shipping product plus the applicable VAT in the respective country, depending on the shipping method, size and weight of the product. Individual solutions can be found if required.
  2. Volume discounts/bookseller discounts are possible.
  3. When purchasing online, the buyer is obliged to correctly specify his shipping zone. Otherwise, VBS Vet Verlag Beratung und Seminar GmbH is not obliged to deliver.
  4. If shipping costs are displayed, these are initially non-binding estimates. The exact costs will be calculated by VBS Vet Verlag Beratung und Seminar GmbH and, if different, sent to the customer with the second binding invoice.
  5. If customs duties or import taxes are incurred in the buyer's country, the buyer is obliged to pay these to the competent authority in his country.
6 Payment options
  1. Payment for deliveries and services of VBS Vet Verlag Beratung und Seminar GmbH is due immediately upon conclusion of the contract.
  2. In the online store, payment is made exclusively via Paypal, Stripe, Klarna or on account.
  3. You can also pay in cash at events and live events.
  4. Customers are not entitled to offset against our claims unless their counterclaims have been legally established or are undisputed. You are also entitled to offset against our claims if you assert notices of defects or counterclaims arising from the same contract.
  5. As the buyer, you may only exercise a right of retention if your counterclaim arises from the same contract.
  6. Installment payments are possible depending on the course offered.
  7. Installment payments are arranged individually for each course or participant. By default, 6 installments are offered, deviations are possible.
  8. VBS Vet Verlag Beratung und Seminar GmbH reserves the right to make partial deliveries in proportion to the amount of the installment payment. However, installment payments for courses must be made in good time so that a total payment is available at the start of the course, unless VBS Vet Verlag Beratung und Seminar GmbH expressly grants other individual conditions in writing.
  9. If a participant defaults on a (installment) payment and does not settle it within three weeks even after a reminder, the entire remaining amount is due immediately.
  10. Failure to pay the remaining amount within a further 14 days will result in exclusion from the course without any claims against the seminar organizer.
  11. In the event of a delay in payment of more than three weeks, reminder fees and default interest of 5 percentage points above the base interest rate announced by the Deutsche Bundesbank for the time of the order may be demanded.
  12. The customer’s obligation to pay default interest does not preclude the provider from claiming further damages caused by default.
7 Liability and disclaimer
  1. Claims for damages by the customer are excluded. Excluded from this are claims for damages by the customer arising from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages resulting from intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract.
  2. In the event of a breach of material contractual obligations, the provider shall only be liable for foreseeable damage typical of the contract if this was caused by simple negligence, unless the customer’s claims for damages are based on injury to life, limb or health.
  3. The restrictions of paragraphs 1 and 2 also apply in favor of the legal representatives and vicarious agents of the provider if claims are asserted directly against them.
  4. The limitations of liability resulting from paragraphs 1 and 2 do not apply if the supplier has fraudulently concealed the defect or has assumed a guarantee for the quality of the item. The same applies if the supplier and the customer have reached an agreement on the quality of the item. The provisions of the Product Liability Act remain unaffected.
  5. VBS Vet Verlag Beratung und Seminar GmbH shall not be liable for claims for damages due to lost profits or other financial disadvantages or damage to property or personal injury that may have arisen due to services or defective services provided by VBS Vet Verlag Beratung und Seminar GmbH, except in cases of demonstrable gross negligence.
  6. Course participants accept that animals can always react unpredictably depending on the situation and that VBS Vet Verlag Beratung und Seminar GmbH cannot be accused of intent or negligence in the event of injuries caused by animals.
  7. Course participants must be vaccinated against tetanus (lockjaw) and have valid liability insurance for personal injury and property damage caused by the participant, as well as accident insurance. VBS Vet Verlag Beratung und Seminar GmbH is not liable for costs and financial disadvantages incurred by the participant or customer if seminars are postponed, changed or canceled. VBS Vet Verlag Beratung und Seminar GmbH reserves the right to make changes to the seminars, which may affect the content, the schedule, the venue and dates or the lecturers.
  8. Any seminar fees paid will be refunded in the event of cancellation, but not in the event of postponement by VBS Vet Verlag Beratung und Seminar GmbH. A partial refund of seminar fees due to a reduction will only be made if courses have to be shortened due to adverse circumstances so that less content is taught overall. VBS Vet Verlag Beratung und Seminar GmbH is not liable for lost profits or consequential damages due to the use of content, products or participation in courses. In the event of defects in the deliveries or services of VBS GmbH, the client or customer has the right to rectification if this is possible.
  9. VBS Vet Verlag Beratung und Seminar GmbH is not liable for any damages arising from the use of linked websites. VBS GmbH reserves the right to change the course location, course date, instructors and mode of further training and is not liable for any costs incurred due to force majeure, changes to the course location, course date, changes to instructors and the mode of further training. A corresponding situation-related adjustment does not lead to any claims for damages or waiver of the payment obligation.
  10. For this reason, VBS Vet Verlag Beratung und Seminar GmbH strongly advises you to check your personal liability insurance, accident insurance and travel (cancellation) insurance or other insurance policies for appropriate benefits and validity (also abroad, if applicable).
  11. Legal recourse is excluded for the redemption of vouchers (voucher codes), sponsor discounts and similar discounts. Payment of the cash value is excluded. VBS Vet Verlag Beratung und Seminar GmbH is not obliged to pay out the cash value. The customer is only entitled to redeem one voucher (voucher code) per purchase and invoice.
8 Right of revocation for consumers

Revocation policy:Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which they or a third party named by them, who is not the carrier, have taken possession of the last goods. of their decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). To comply with the revocation period, it is sufficient to send a notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of revocation:

  1. If the consumer has requested that the contractual service should commence during the withdrawal period, he shall pay a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which he was informed of the exercise of the withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.
  2. If the consumer withdraws from this contract, all payments received up to that point must be repaid immediately and at the latest within 14 days from the day on which the publisher receives notification of the withdrawal from this contract. The same means of payment that was used for the original transaction shall be used for this repayment, unless expressly agreed otherwise; under no circumstances shall fees be charged for the repayment. Repayment may be refused until the goods have been returned or until proof has been provided that the goods have been returned, whichever is the earlier. The goods must be returned or handed over immediately and in any case within 14 days at the latest from the day on which the consumer declares the revocation of this contract. The deadline is met if the goods are dispatched before the expiry of the 14-day period. The consumer shall bear the direct costs of returning the goods.
  3. The consumer only has to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check their condition, properties and functionality.
9 Cancellation policy
  1. By sending in the registration documents or sending the online registration, the registration is binding on the part of the customer, whereas on the part of VBS Vet Verlag Beratung und Seminar GmbH it is subject to the examination of the admission requirements.
  2. Irrespective of the right of withdrawal, VBS Vet Verlag Beratung und Seminar GmbH grants the customer the right to cancel a registration for a VBS Vet Verlag Beratung und Seminar GmbH course in accordance with the following conditions:
  3. Cancellations must always be made in writing to us. An e-mail is sufficient, and the cancellation is valid if its receipt is confirmed by VBS Vet Verlag Beratung und Seminar GmbH. The Central European Time Zone (CET) applies unless otherwise defined.

  4. If the cancellation is made up to 12 weeks before the start of the course, a cancellation fee of 15% of the course fee must be paid or will be retained. If a cancellation is made within 11 to 6 weeks before the start of the course, 50% of the course fee paid can be refunded or will be due. In the event of a later cancellation (less than 6 weeks before the start of the course), refunds are no longer possible, i.e. the entire course fee is due. The term “course” here includes Classroom courses, seminars, workshops and other (face-to-face) events.

  5. In the case of a blended learning course (combination of traditional classroom teaching with phases of online teaching), the same cancellation conditions apply. If the e-learning part of the course has already begun, it is no longer possible to cancel it completely. Cancellation of a blended learning course – if access to e-learning already exists – is subject to a cancellation fee of at least 2400 euros.
  6. Pure e-learning courses and webinars/symposia can only be revoked within 14 days in accordance with the statutory revocation period, provided that it can be proven that no dial-in has taken place.
  7. If a Lab Day is canceled later than 6 weeks before the date of the appointment, no refund is possible.
10 Return conditions for shipping items
  1. You have the right to return goods purchased from us without giving any reason within 30 days of receipt of the goods. This gives you enough time to check the product and decide whether it meets your expectations.
  2. For a successful return, the returned item should not be damaged. We ask you to pack the goods securely to ensure that the items are not damaged in transit and arrive in good condition.
  3. If the product, such as books, has a code for online access, the product can only be returned if the code has not yet been redeemed.
  4. We will endeavor to refund the purchase price as soon as possible, but in any case within 14 working days of receipt of the returned goods. The refund will be made to the original means of payment that you used when placing the order. This is to make the process as easy as possible for you.
  5. The customer shall bear the costs of returning the goods.
    This includes any customs charges.We ask that you send the goods securely and with a traceable shipping method to ensure that they reach us.
  6. Please note that we cannot accept returns of personalized items.
    In addition, we do not accept returns of goods that are in a condition that makes resale impossible.If the product was already damaged upon arrival at the customer, we will accept the return.
  7. Please note that in the event of a return, we will only refund the value of the goods.
    Any shipping costs incurred will not be refunded.This also applies if you keep the item but return part of your order.
 11 Usage rights and copyrights
  1. Our digital content is protected by copyright. No ownership of this content is granted. You only receive the simple, non-transferable right to use the digital content offered for a limited period of time for exclusively personal use in accordance with copyright law in the manner offered in each case. Only one person can be admitted per license slot.
  2. The purchaser or user may only use the purchased or received content, documents or products for themselves and their own purposes. It is not permitted to change the content or editing of digital content in any way or to use modified versions, copy it for third parties, make it publicly accessible or forward it, post it on the Internet or in other networks for a fee or free of charge, imitate it, print it out, sell it on or use it for commercial purposes. Abuse of copyright will be prosecuted under civil and criminal law.

12 Jurisdiction and applicable law
  1. The law of the Federal Republic of Germany shall apply. For consumers who do not conclude the contract for professional or commercial purposes, this choice of law shall only apply insofar as the protection granted by mandatory provisions of the law of the country in which the consumer has his habitual residence is not withdrawn.   4. Should individual provisions of the contract with the customer, including these General Terms and Conditions, be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.
